This policy covers the entire PointGenie Platform—not only the business landing page—including the mobile app, PoX, check-ins, business accounts, free QR claims, GenieTags and White Glove services.
1. Scope
This Privacy Policy explains how PointGenie LLC (“PointGenie,” “we,” “us,” or “our”) collects, uses, stores, discloses and protects personal information when you use our websites, mobile applications, APIs, business dashboards, NFC-enabled products, QR codes and related services (collectively, the “Platform”). PointGenie LLC is organized under the laws of the State of New Jersey, United States, and operates globally.

2. Information We Collect
Information you provide
- Account and profile information: name, username, email, phone number, password credentials or authentication identifiers, profile photo, language and preferences.
- Business information: business name, category, address, contact details, hours, logo, menus, services, social links and proof that you are authorized to claim or manage a location.
- Content: check-ins, photos, videos, reviews, comments, events, experiences, messages and other material you choose to upload or share.
- Orders and leads: selected products, free QR claims, White Glove requests, shipping and billing contact information, coupon use and order history.
- Communications: support requests, survey responses, onboarding materials and other information you send to us.
Information collected automatically
When you use the Platform, we may collect IP address, device and browser type, operating system, app version, device identifiers, language, referring pages, timestamps, crash and diagnostic data, feature interactions and security logs. We use cookies, SDKs and similar technologies as described below.
3. Location and Check-In Information
Precise location is collected when you initiate a location-dependent action—such as confirming a check-in, finding nearby places or attaching a place to an event—and grant the required device permission. PointGenie does not continuously track precise location in the background without an enabled feature, permission and lawful basis.
A check-in may include the selected place, date and time, crowd level, wait time, vibe, media and engagement. Depending on your settings and the feature, some of this information may be displayed publicly or shared with a business, other users or people receiving a shared link. You can control device location permission through your operating-system settings, although disabling it may prevent location features from working.
4. Business Listings, QR Codes and GenieTag Analytics
Business listings may contain information from public sources, business owners, users and providers such as mapping or business-directory services. When you search for or claim a business, we may process the business query, selected location and verification details.
When someone scans or taps a PointGenie QR code or GenieTag, we may record the tag or code identifier, destination, timestamp, approximate location derived from IP, device/browser information and subsequent actions on the landing page. We use this information to operate links, detect abuse and provide aggregated performance analytics to the associated business. We do not use an NFC tag to access unrelated information stored on a visitor’s phone.
5. Purchases, Payments and Fulfillment
Payment-card details are collected and processed by our payment provider, such as Stripe; PointGenie does not receive or store complete card numbers. We and our processors receive transaction identifiers, payment status, billing details and fraud signals. We share necessary name, address, phone, email and order details with shipping carriers and fulfillment providers to deliver physical products.
6. Third-Party Accounts and Integrations
If you connect or interact with Google, Apple, social networks, maps, messaging services or other third parties, we may receive information allowed by your settings and authorization, such as an account identifier, profile information, business details or destination link. Third-party services process information under their own policies. You can usually revoke access through the third party or your PointGenie settings.
7. Automated and AI-Assisted Features
PointGenie may use automated systems and service providers to rank public content, identify notable check-ins, prevent fraud, translate content and generate draft marketing assets such as social cards, captions, flyers, carousels or videos from eligible check-ins, events and business information. Drafts may be reviewed by a person before publication. We do not use automated processing to make decisions that produce legal or similarly significant effects without appropriate notice and safeguards.
8. How We Use Information
We use information to:
- Create, authenticate and support user and business accounts.
- Operate check-ins, live place signals, events, experiences, sharing and notifications.
- Generate, activate and route QR codes and GenieTags.
- Process orders, deliver products and perform White Glove onboarding.
- Provide dashboards, aggregated analytics and business insights.
- Personalize content and improve performance, safety and accessibility.
- Communicate service notices, support responses and permitted marketing.
- Detect spam, duplicate claims, fraud, security incidents and policy violations.
- Comply with law, enforce agreements and protect users, PointGenie and the public.
Depending on the jurisdiction, our legal bases include performing a contract, consent, compliance with law and legitimate interests such as securing and improving the Platform.
10. Communications, Push Notifications and Your Choices
We may send transactional email, SMS, WhatsApp messages or push notifications about account security, orders, claims, activations, events and service changes. Promotional communications are sent where permitted by law and can be stopped using the unsubscribe link, replying STOP where supported, changing app notification settings or contacting us. Opting out of marketing does not stop essential service messages.
You can manage push notifications and location access through device settings. Business owners may update many listing and menu details through their account.
11. Cookies and Similar Technologies
We use necessary cookies for sessions, security, language and checkout; preference cookies for remembered choices; and analytics technologies to understand use and improve the Platform. Advertising or cross-context tracking technologies, if used, are subject to applicable consent and opt-out requirements. Browser “Do Not Track” signals are not uniformly standardized; where legally required, we honor recognized opt-out preference signals.
12. Public Content
Information you publish to a public profile, business page, check-in, experience or event may be seen, copied or reshared by others and may appear in search engines. Deleting an account does not guarantee removal of copies previously shared by other users or third parties. Businesses generally cannot remove accurate public business facts or independent user content solely by closing an account.
13. Data Retention
We retain information for as long as needed to provide the Platform, maintain business and tax records, resolve disputes, prevent fraud and comply with law. Retention varies by data type and account status. We may retain limited records after deletion when required by law, necessary for security or needed to document a request. Backup copies are removed according to our normal backup cycles.
14. Security
We use commercially reasonable administrative, technical and organizational measures designed to protect information. No network, device, transmission or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for using a strong password and protecting account credentials.
15. International Transfers
PointGenie operates globally. Information may be processed in the United States and other countries whose privacy laws differ from those where you live. Where required, we use recognized transfer mechanisms and contractual safeguards.
16. Your Privacy Rights
Depending on your location, you may have the right to request access, correction, deletion, restriction, portability or objection to certain processing; withdraw consent; opt out of certain targeted advertising or sharing; and appeal a denied request. California and other U.S. state residents may also request information about categories collected, sources, purposes and recipients and may exercise rights without unlawful discrimination. European Economic Area, United Kingdom and similar jurisdictions may permit a complaint to the relevant supervisory authority.

17. Children’s Privacy
The Platform is not directed to children under 13, or the higher minimum age required by local law, and we do not knowingly collect their personal information. If you believe a child provided information without appropriate authorization, contact us so we can investigate and delete it where required.
18. Account Deletion
You may request deletion through available account controls or by emailing [email protected]. After identity verification, we will delete or de-identify eligible account information, typically within 30 days, subject to legal, fraud-prevention, security and recordkeeping exceptions. Public business facts, independent reviews and content belonging to other users may remain.
19. Changes to This Policy
We may update this policy as the Platform or law changes. We will post the revised version with an updated date and provide additional notice when legally required. Your continued use after the effective date means the updated policy applies.
